Well I am glad I have not managed to get any photos of family and friends up on iStock.
After reading this thread it is apparent that the sensitive use clauses in the agreements are not taken seriously by iStock.
My problem is that I would have told the old man that his photo would not be used in an that manner, and it would have been a lie. The fact that I truly believed that this would not happen would not make me feel any better.
I will now only use models for shoots, and I will tell them that there is no protection against offensive use, in fact I will use this case as an example. I will also be contacting the 3 models from the iStockOzalypse and asking them, if in the context of the above thread, they would like me to remove their photos. If they want me to I will.
I realize that anyone can do this to any picture on the web, but by not trying to stop it, iStock is condoning it.
I also think iStock should also remove this:
We’ve entirely removed the option for extending a license to cover socially sensitive usages. You can make your portfolio available without having to worry about future usage you may be uncomfortable with.
I have no problem dealing with iStock under these terms, but they should be up front and honest about what they will allow.
